Terms of Service – Protected Processing

Welcome to Trust My Travel!

You are buying on TRAVEL PROVIDER’s Website, and the products displayed on the website are those of the TRAVEL PROVIDER. However, please be aware that TRAVEL PROVIDER uses Trust My Travel Limited, or depending upon your location, its affiliate, Trust My Travel US LLC, TMT (HK) Limited (in all cases, doing business as trustprotects.me), to financially protect your purchase. As a result any purchases made by you will be protected using Trust My Travel.

The protection of your purchase is subject to Trust My Travel’s Terms and Conditions, the Trust My Travel Privacy Policy and relevant terms imposed by TRAVEL PROVIDER. By taking no action to cancel the protection through Trust My Travel included by the TRAVEL PROVIDER in your purchase you agree to be bound by the same. Please read all of the terms and privacy policy.

TRAVEL PROVIDER makes Trust My Travel available to facilitate financial production of products to consumers included in the price you paid to the TRAVEL PROVIDER.

By placing an order through the TRAVEL PROVIDER, you acknowledge and agree that:

(a) Trust My Travel shall be entitled to verify and authenticate your payment information, and if it is unable to verify this information, merchant representatives may contact you and/or your payment card issuer to confirm your identity and/or your intent to place the order;

(b) Trust My Travel makes no commitment to process the protection for your purchase until Trust My Travel has accepted your order and issued a receipt complete with a Trust ID, and reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion;

(c) If you are under the age of 18, approval of your parent or guardian is required to transact with Trust My Travel; and

(d) The Trust My Travel service is governed by our Privacy Policy and your consent to use your Personal Information for the purposes of completing a payment and fulfilling the product/service you purchase. Acceptance of our Privacy Policy is required to provide you with service.

TRAVEL PROVIDER Responsibilities.
Questions about your order may be directed to Trust My Travel for initial intake and processing, and will be referred to TRAVEL PROVIDER by Trust My Travel as necessary.

TRAVEL PROVIDER FAILURE AND NON-FULFILMENT
Trust My Travel uses its Financial and Supplier Failure Insurance Policy to protect you against the insolvency of TRAVEL PROVIDER (Insolvency Event). We do this by declaring you and your booking against TMT’s insurance policy.

Any non-fulfilment or partial non-fulfilment due to an Insolvency Event only (a “Claim”) with a Booking must be reported to us by email to dispute@trustmytravel.com within 72 hours of when your booking should have been fulfilled (for example if you book tickets for a performance on 1st May then you have until 4th May to report non-fulfilment).

Insolvency Event means an event of insolvency in relation to the Client as set out below:

  • a bankruptcy order has been made by a court having jurisdiction over the Clients affairs;
  • an administration order has been made by a court having jurisdiction over the Clients affairs;
    an effective resolution or order for the voluntary winding up has been made by a court having jurisdiction over the Clients affairs;
  • a voluntary agreement or compromise, supervised by an insolvency practitioner, has been made binding on the Client;
  • an administrator, receiver or liquidator has been appointed on behalf of debenture holders or other creditors of the Client; or such circumstances exist which are, in our opinion, equivalent to the above.

If an issue is not reported in accordance with these terms and conditions then you will not have any form of redress against us, our representatives or our underwriters under these terms.

Any Claim will be dealt with within 28 days of the date that the Booking (or part of the Booking in the case of partial non-fulfilment) should have been fulfilled if the Travel Products had been delivered in accordance with the terms of the Booking recorded in the Trust My Travel system have been complied with and the Claim is found to be valid by our insurance provider, we (or our nominated representatives) will reimburse you all or part of the Payment or, where applicable, arrange a repatriation to your departure point, in the UK only.

Once this reimbursement offer has been accepted by you this will immediately close the Claim. You shall not be entitled to any other compensation from us, our representatives or our underwriters.

Our insurance provider will investigate all Claims reported. If your Claim is not substantiated by our insurance provider you will not be entitled to any reimbursement.

A Claim will only be substantiated if the non-fulfilment or partial non-fulfilment is covered by our underwriters. Generally a Claim will only be substantiated if it arises due the Insolvency Event of your TRAVEL PROVIDER, as per the description of an insolvency event as per the above, and you are able to provide confirmation of booking with, and payment to TRAVEL PROVIDER.

If TRAVEL PROVIDER goes out of business before you have left your departure point we will inform you, where possible, and we will make arrangements for a full reimbursement of Payment or (as your agent) delivery of the Travel Products to you from any third party supplier, provided always that we are satisfied that the Payment is protected or suitable insurance arrangements are in place; and we are able to agree this with the third party supplier. You shall not be entitled to any other compensation for any other claim from us, our representatives or our underwriters.

If TRAVEL PROVIDER goes out of business once you have left your departure point or if we are unable to inform you before you depart then you should call the 24hour emergency contact number on +44 1780 679894 immediately. We will make arrangements for replacement Travel Products or services (up to the value of the Travel Products being replaced) or will confirm in writing a full or partial reimbursement of the Payment for you to arrange replacement Travel Products.

In the case of replacement Travel Products or services we will inform you, and you can either accept such Travel Products or services in which case you will enter into a new booking contract with the provider of such replacement Travel Products or services or alternatively you can make your own arrangements and seek a reimbursement of all or some of the Payment. You shall not be entitled to any other compensation for any other claim from us, our representatives or our underwriters.

We accept no responsibility for the Travel Products or delivery thereof and shall not be liable for any breach of the Booking, misrepresentation, negligence or other failure on the part of TRAVEL PROVIDER or any third party supplier.

We accept no responsibility and we will not provide you with a reimbursement where you have been unable to enjoy your Travel Products where you are at fault (including but not limited to where you do not have or are missing travel documents or you have failed to obtain the necessary vaccinations to enjoy your Booking.) You will be treated as “no show” and will have no claim against us, our representatives or our underwriters.

INTELLECTUAL PROPERTY.
You acknowledge that all content included in the TRAVEL PROVIDER checkout and Trust My Travel, such as software, object code, source code, text, graphics, logos, button icons, images, audio clips, and digital downloads, is the property of Trust My Travel, and TRAVEL PROVIDER. All designs, graphics, logos, page headers, button icons, scripts, and service names are trade-marks or registered trade-marks of TRAVEL PROVIDER or Trust My Travel, as may be applicable, in the U.S. and/or other countries. Such trademarks may not be used without the prior written authorization of TRAVEL PROVIDER or Trust My Travel, as may be applicable.

GOVERNING LAW AND JURISDICTION
This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).
